1. Introduction

Welcome to Tech Enthusiast Academy (TEA), an educational platform owned and operated by Tech Enthusiast, a Finnish company. TEA serves as the online hub for a wide range of courses, media, and content focused on Enterprise IT and other technology-related subjects.

By accessing and using TEA, you agree to these Terms of Use, which are designed to ensure a supportive, respectful, and productive learning environment for all users.


2. Definitions

2.1. Tech Enthusiast Academy (TEA): An educational platform that provides access to Courses, media, and Content related to Enterprise IT and other technology subjects, owned and operated by Tech Enthusiast.

2.2. User(s): Individuals or entities who access, browse, or interact with TEA, including Students, Registered Users, and Visitors.

2.2.1. Students: Users who have enrolled in free Course(s) or have purchased access to paid Course(s).

2.2.2 Registered Users: Users with an account, gaining additional features beyond those available to Visitors but how have not enrolled in paid or free Courses.

2.2.3 Visitors: Individuals or entities browsing TEA without an account.

2.3. Content: Refers to ALL educational materials and resources made available through TEA, including, but not limited to, Courses, Lightboarding models, videos, articles, downloadable files, quizzes, certificates, and free Course previews.

2.3.1. Course(s): A type of Content, consisting of a sequence of educational Content organised for comprehensive learning.

2.3.2. Lightboarding models: A type of Content, consisting of the Instructor's freehand drawings that illustrate certain topics.

2.4. Instructor: Refers to Markus Leinonen, the primary educator behind TEA's Courses.

2.5. License: Grants a Student non-exclusive, non-transferable, and revocable access to TEA's Course(s) for personal, non-commercial use, subject to these Terms. This License does not confer ownership of any Content or intellectual property rights to the Student.

2.6. Services: Tailored offerings including technical infrastructure, interactive features, and support services to enhance user experience.

2.7. Third-Party Links and Services: Digital resources, services, and platforms not owned by TEA but used to support its educational content and marketing.

2.8. Personal Identifiable Information (PII): Information that can be used to identify an individual, protected under TEA's and Teachable’s Privacy Policy.

2.9. Intellectual Property: Proprietary materials and Content available through TEA, protected by copyright laws, common law trademark rights, and any other applicable rights under Finnish law and international agreements.


3. Eligibility and User Accounts

3.1. Eligibility Requirements:

TEA is dedicated to individuals eager to enhance their skills and knowledge in Enterprise IT and related technology areas. To ensure a conducive learning environment TEA stipulates the following eligibility criteria for all Users:

3.1.1. Minimum Age Requirement: Users must be at least 18 years old to independently use the platform. Individuals between the ages of 13 and 17 may use TEA only with the permission and involvement of a parent or guardian. By using TEA, Users confirm that they have secured such permission and thus meet the age requirements set forth. TEA does not permit the use of its platform by anyone under the age of 13.

3.1.2. Foundational Knowledge: TEA recommends that all Users have a foundational understanding of Enterprise IT to fully benefit from the Courses and resources available on the platform.

3.2. Account Registration:

Access to certain features and Courses on TEA requires an account registration. This includes enrolling into any Course offered on TEA, whether free or paid. During account registration, Users agree to:

3.2.1. Provide accurate, current, and complete information about themselves as prompted by the registration form.

3.2.2. Maintain and promptly update their account information to keep it accurate, current, and complete.

3.2.3. Secure their account by restricting access to their account and computer and by not sharing their account details with others.

3.2.4. Accept full responsibility for any and all activities that occur under their account.

By creating an account on TEA, Users affirm their acceptance of these terms and their commitment to abide by the eligibility requirements and account maintenance standards outlined herein.


4. Use License

Access to and use of TEA are subject to these Terms of Use. TEA reserves the right to modify or discontinue any aspect of its Services or Content at any time.

Users may:

  • Use the Course(s) and Content for their own educational purposes.
  • Download one copy of any downloadable materials for personal, non-commercial use.
  • Interact with any features within TEA, such as surveys and quizzes.
  • Interact with the TEA community and community members.

Users may not:

  • Disclose their TEA login credentials, such as email and password, to third parties.
  • Record, share, or distribute Course(s) and free Course previews.
  • Present, share, reproduce, modify, or distribute Lightboarding models and Course materials. These are for personal educational purposes only!
  • View the Course(s) with third parties.
  • Distribute, modify, reproduce, or copy any other Content found on TEA, including articles and web page copy.
  • Display or perform TEA Content publicly.
  • Attempt to decompile, reverse engineer, or dismantle any software or Content on TEA.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices on TEA Content.
  • Host, mirror, or redistribute any TEA Content on any other server or platform.
  • Create derivative works from TEA Content.
  • Use TEA Content for any commercial purpose.
  • Engage in or facilitate illegal activities using TEA Content.
  • Interfere with or disrupt the integrity or performance of TEA's platforms, servers, or networks.
  • Collect and download User data, including PII, from TEA and the TEA community.
  • Engage in unauthorised promotion, advertising, or marketing of TEA Content on external platforms, including social media.
  • Post or transmit any content that is defamatory, harassing, offensive, or otherwise objectionable in connection with TEA Content. This includes User reviews, comments, or any form of feedback that might harm the reputation of TEA or its Users.

Any deviation from these restrictions requires prior written approval from TEA.

The User License shall automatically terminate upon the violation or suspicion of violation of any of these restrictions. After License termination, the User must destroy any downloaded Content in their possession, whether in electronic or printed format. In the event of License termination due to Use License violation, there will be no refunds, and the money-back guarantee is considered void.

In addition, violation of these terms will result in legal action.


5. General Compliance

Users are expected to comply with all applicable laws and regulations in addition to these Terms. Responsibility for legal compliance rests with each User, in accordance with the laws of their jurisdiction.


6. Prohibited Conduct

Users must not engage in conduct that is harmful, illegal, or against the interests of the TEA or TEA community. Specific prohibitions include, but are not limited to, copyright infringement, harassment, and unauthorized commercial use of Content. Users are also required to adhere to TEA's Community Guidelines, which outline additional standards and expectations for behavior within the TEA community. Any violation of these guidelines will be considered a breach of these Terms.


7. Intellectual Property Rights

All Content and Services provided by TEA, including Courses, are the intellectual property of Tech Enthusiast or its licensors. Users are granted a License to access and use this Content for personal, educational purposes only.


8. Content Accuracy and Updates

As stated in the ‘Disclaimer’ section of these Terms, TEA strives to provide high-quality, accurate Content. However, the Content available on TEA, including Courses, free Course previews, Course materials, and web page copy may occasionally contain technical, typographical, or photographic errors. TEA does not guarantee the complete accuracy, completeness, or currentness of any Content on the platform.

TEA reserves the right to make changes to the Content offered on the platform at any time without prior notice. While TEA aims to keep the Content up-to-date and may periodically update it, there is no obligation or commitment to ensure that all Content on the platform are updated or corrected immediately upon discovery of errors.


9. User-Generated Content

Users may be able to post comments, reviews, and other content within the TEA platform. By submitting any content to TEA, Users grant Tech Enthusiast a perpetual, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, and distribute such content. TEA owns all user-generated content, including comments, reviews, and community activity, and can use it for marketing purposes, even if it contains personal identifiable information (PII).

Users agree that any user-generated content they post will not infringe on the rights of any third party, including intellectual property rights, privacy rights, or any other personal or proprietary rights. TEA reserves the right to remove or edit user-generated content for any reason, including content that TEA determines, in its sole discretion, violates these Terms or is otherwise objectionable.


10. Third-Party Links and Services

TEA may include or offer third-party links, services, and resources on its platform not reviewed, controlled, or maintained by TEA. These links are provided for convenience to enhance the Users’ learning experience and to support TEA's educational Content and marketing efforts. The presence of any third-party link does not constitute an endorsement, guarantee, warranty, or recommendation by TEA. We are not responsible for the content, privacy policies, or practices of any third-party sites or services linked to or from our platform.

Users engage with any third-party links and services at their own risk. TEA encourages Users to read the terms and privacy policies of any third-party sites or services that they access.


11. Non-Compete and Non-Replication

All Users of TEA, whether Students, Registered Users, or Visitors, agree not to replicate, monetize, or use TEA’s Content, including but not limited to Courses and free Course previews, for any competing purposes or commercial advantage. This prohibition extends to the creation of derivative works or services that directly compete with TEA or exploit its Content and intellectual property without explicit, written authorization from TEA. Unauthorized actions, including but not limited to the development, promotion, or distribution of competing content or services, will lead to immediate termination of any granted Licenses, potential revocation of access to TEA, and legal consequences.


12. Disclaimer

The Content provided on TEA is offered on an ‘as is’ and ‘as available’ basis without warranties of any kind, either expressed or implied. TEA and its owner, Tech Enthusiast, hereby disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement of intellectual property or other violation of rights. Furthermore, TEA is not responsible for the accuracy or effectiveness of its own Content or any content on external sites that can be accessed through links provided on TEA.

Professionals using TEA for career advancement or industry applications are advised to exercise their own professional judgment and discretion when applying the Content. TEA does not warrant that the Content will meet all professional standards or requirements and disclaims all liability for any professional decisions made based on the Content.


13. Limitations of Liability

In no event shall TEA, its owner Tech Enthusiast, or its affiliates be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of the use or inability to use the Content and Services on TEA, even if TEA or an authorized representative has been notified of the possibility of such damages. This includes, without limitation, any damages resulting from loss of business, clients, and profits, or from any reliance placed by the User on the completeness and accuracy of any Content provided on TEA.

The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. Some jurisdictions do not allow limitations on implied warranties or limitations of liability for consequential or incidental damages, so these limitations may not apply to every User.


14. Refund Policy

TEA offers a 14-day money-back guarantee for Course purchases, calculated from the date of purchase, subject to the following terms and conditions:

The refund request must be made within 14 days from the date of purchase. Refunds will not be granted if more than 30% of the Course has been accessed and consumed. The money-back guarantee can be used only once per Student, identified by name, address, and email address to prevent policy misuse.

To request a refund, please email us at support (at) techenthusiast.com from the same email address used for the purchase. Include your payment receipt and provide feedback on what could have been improved to meet your expectations. TEA will respond to refund requests within 7 business days.


15. Breach of Agreement

Violating these Terms can result in Course access revocation and potential legal action by Tech Enthusiast, including claims for damages and injunctive relief. In the event of such a violation, no refunds will be provided, and the 14-day money-back guarantee will be void.


16. Privacy

TEA is committed to protecting the privacy of its Users. To understand how we collect, use, and safeguard our Users’ personal information, please review our Privacy Policy. Additionally, as Teachable provides the underlying platform for TEA, we recommend that Users also review Teachable’s Privacy Policy.


17. Changes to Terms

TEA reserves the right to modify these Terms of Use at any time. Continued use of TEA after such changes constitutes agreement to the new Terms.


18. Governing Law

These Terms of Use shall be governed by the laws of Finland, without regard to its conflict of law provisions.
